STATEMENT OF ACCUSED UNDER SECTION 313 OF CR. P. C.

Occu. : Driver R/o. : Bilal Masjid, Pipali Chouk,
zhun Zhun, Rajasthan.
(As per section 313(4)(5) of Cr.P.C., you are hereby explained that you shall
not rendered yourself liable to punishment if you refused to answer any
questions put by this Court to you in your statement under section 313 or you
give false answers to them. You are also explained that you are not bound to
answer the questions which would be put to you and if you answer those
questions, your answers will be considered in evidence along with other
evidence.)
Que.1 : Have you heard the evidence and did you understand it?
Ans. : Yes.
Que. 2 : It has come in the evidence of PW No.1- Kranti Sarang Patil, PI.
Special Branch-I - on the night intervening 18.11.2017 and 19.11.2017 she
was working as a Immigration Officer at Chhatrapati Shivaji Maharaj
International Airport. Airport with Special Branch-II from 08:00 p.m. to 08:00
a.m. She was Duty Officer that night. Around 09:15 p.m. staff of Air Arabia
Airlines of flight No. G9 402, brought you accused before Wing In-charge Mr.
Sunil Zarekar as he was deported from Sharjah to Mumbai. What do you
want to say about it?
Ans. : It is false.
Que. 3 : It has further come in her evidence that The Airline staff handed over
you accused with passport, deportee note, tourist visa and letter from the
Airlines. They inquired with you accused. They learnt that you accused was
deported from Kingdom of Saudi Arabia. You accused initially went to
Sharjah on Tourist Visa on 12.11.2017 and then you tampered the said visa by
affixing fake employment visa on the passport. You accused were holding
E.C.R. passport, hence it was necessary to obtain Protector of
Emigrants(P.O.E.) for obtaining employment visa. In order to avoid the
process of obtaining P.O.E., you accused initially obtained Tourist Visa and
after reaching Sharjah you procured fake employment visa. Then you accused

travelled from Sharjah to Hail, Saudi Arabia. Immigration Authority, Hail
deported you accused to Mumbai. What do you want to say about it?
Ans. : It is false.
Que. 4 : It has further come in her evidence that She now shown the original
passport (Exh.06) of the accused. Her attention is drawn to page No.5 of the
passport on which the said employment visa is affixed. The original boarding
pass (Exh.07) of you accused of flight No. G-9 401 dated 18.11.2017. After
inquiry, she handed over you accused along with documents to Sahar Police
Station and lodged report against you. The F.I.R. (Exh.8) & printed F.I.R.
(Exh.9). What do you want to say about it?
Ans. : It is false.
Que.5 : Why the witness is deposing against you ?
Ans : I do not know.
Que.6 : Do you want to examine yourself on oath ?
Ans. : No.
Que.7: Do you want to lead defence evidence ?
Ans. : No.
