ORDER BELOW THE APPLICATION OF ACCUSED/APPLICANT FOR
PERMISSION TO TRAVEL ABROAD.

1. The accused, Mr. Asif Hussein Nabi, who is facing trial for
the offence punishable under Section 420 and 406 r/w. 34 of Indian
Penal Code r/w. 3,4,5,8 and 13 of Maharashtra Ownership of Flats Act,
has filed this application for grant of permission to travel Italy,
Switzerland and Europe from 6th November, 2024 to 22nd November,
2024 (17 days) as mentioned in the application. The accused
undertakes he shall not temper the evidence.
2. In view of this application, the say of the learned APP was
called. The learned APP submitted that conditional order may be
passed. Moreover, the case against the accused is pending before this
Court. So also, he has filed relevant documents to support his claim.
Hence, having regard to the conduct of the accused, his urgent need
and his bonafide submission, I do not find any hurdle to allow this
application subject to the following conditions.
ORDER
1) The application is hereby allowed.

2) The applicant/accused, Mr. Asif Hussein Nabi, is hereby
permitted to travel Italy, Switzerland and Europe from 6th November,
2024 to 22nd November, 2024 (17 days) subject to furnish surety bond
alongwith Cash security of Rs.15,000/ (Rupees Fifteen Thousand
Only).
3) He is further directed to attend the Court after arrival in
Mumbai. So also he shall give details of his abroad residential address
where he will stay. So also he shall furnish his telephone/mobile
number and other details of his communication for securing his
presence.
4) The learned advocate of accused should remain present on
due date for conducting of the trial without any excuse and the accused
shall not make any dispute about the identity of the witness during the
trial.
