Deposition of Witness No. 02 for Prosecution.
I on solemn affirmation depose as under :
My Name : Kavita Aniket Naik

Exam.-in-chief by APP Shri. K. S. Jamdhade for the State:-
1. On 26.02.2018 I was working at Sahar Police Station as
P.S.I. I have registered crime No. 65/2018 on that day on the report
lodged by Immigration Officer Ms. Pallavi Chauhan, pertaining to
cheating by using another passport. Immigration Officer produced the
impugned passport, boarding pass, PISON copy of Indian Passport and
air ticket from Damam to Muscat and Muscat to Mumbai, etc. I seized
the same by preparing panchnama in presence of two panch witnesses.
That panchnama is now shown to me. It bears my signature and
signatures of pancha witnesses. Its contents are true & correct. It is
marked as Exh-13. I recorded the statements of witnesses. I could not
gather information about the wanted accused on whose passport the
present accused had travelled, but I could not gathered any information
about him. I arrested the accused during investigation. I forwarded the
letter to Regional Passport office, Lucknow for verification of the
impugned passport. I also made correspondence with S.P. Office, Sant
Kabir Nagar, Uttar Pradesh for verifying the identify and address of
accused. After completion of investigation I filed charge-sheet. I can
identify the accused. He is not present before Court today.

Cross-examination by Learned Counsel Shri. D.V. Mangaonkar for
accused:-
2. It is true to say that accused had travelled on his
original passport No K-9905424 in the year 2014. It is true to say
that the Immigration Officer did not produce the passport before
me after seizing it by preparing the panchnama. It is true to say
that passport of the accused was seized in Saudi Arabia. It is not
true to say that hence accused was travelling on an Emergency
Travel Certificate issued by the Embassy, to him. It is not true to
say that accused was not travelling on the passport which is shown
to be seized in the matter. It is not true to say that I filed incorrect
charge-sheet without conducting proper investigation.
