ORDER BELOW EXH. 01
The complainant is absent when called out repeatedly. The
counsel for the complainant is also absent. Perused the record. It
reveals that since last many years no steps have been taken in this
matter and complainant has failed to secure the presence of the accused
and to take effective steps. Already by passing order below Exh. No. 1,
matter was kept for appropriate order observing that complainant is not
taking steps and last chance was granted to complainant to take
necessary steps. It seems that the case is old one. Further it seems that
the complainant is not keenly interested to proceed further. In such
circumstances, it would not be appropriate to keep the matter pending
unnecessary without any progress. In result I pass following order:
ORDER
1. The case is dismissed vide 256 of Cr.P.C. and the
accused is/are acquitted.
2. Record and proceeding be sent to record room after
necessary compliance.
