Deposition of Witness No. 02 for Prosecution.
I on solemn affirmation depose as under :

R/o. : B-303, Island Complex, Island Plaza, Charkop, Kandivali
West, Mumbai.
Exam.-in-chief by APP Mr. K. S. Jamdhade for the State:-
1. I was working as Ramp Service Executive at AI Airport
Service Limited, in Equipment Maintenance Department of Andheri,
Mumbai on 22.02.2018. My duty hours were from 08:00 A. M. to 04:00
P. M. I know the accused since he was working in Equipment
Maintenance Department as service engineer, he was later on transferred
to emergency team which works 24 x 7 in three shifts.
2. On 19.02.2018, Senior AGM Mr. Sharma asked us to wait
after the duty hours on account of arrival of Canadian Prime Minister at
Mumbai Airport, hence I was at airport bay till 07:45 p.m. After that I
was returning to our workshop i.e. Equipment Maintenance Department,
for collecting our belongings and returning home. At around 07:45 P. M.,
at center table of Equipment Maintenance Department I saw the accused
and a equipment Ground Power Unit No. 1389, accused was having
cleaning cloths in his hand, the cap of the diesel tank of GPU 1389 was
open and diesel was lying on the floor. The accused was cleaning the
diesel with the cloth. Since the accused was working in Emergency
Department, his presence was expected in the airport and not in the
Equipment Maintenance Department. Junior Executive Technical Mr.
Subhash Singh, who was accompanying me demanded an explanation

from accused. Accused did not give a satisfactory answer. The vehicle of
accused i.e. Mahindra Scorpio was parked outside the gate of
Equipment Maintenance Department, where usually vehicle of CEO is
parked. I went to see the Mahindra Scorpio car of accused and found
that, there was a diesel spilling mark on the vehicle and on the ground
beneath the vehicle. I informed the said fact to Mr. Subhash Singh, who
in turn informed his superior Mr. Ganesh Chowdhary. Police recorded
my statement.

Cross-examination by Learned Counsel Mr. Siddharth Desai for
accused:-
3. My memory was refreshed before my testimony by the
public prosecutor by handing over my statement recorded by the police.
Every person entering the Equipment Maintenance Department is
checked at the time of ingress and egress. There is only one entrance to
Equipment Maintenance Department. It is true to say that, the key of
GPU is always kept in the vehicle itself. Approximately 100 to 150
people work in the Equipment Maintenance Department, and they can
easily access the center table area. It is true to say that, there is electric
supply at center table, and the GPU was approximately 10 feet away
from center table. It is not true to say that, I saw the accused from the
backside when I first reached near center table. The accused was
standing there and he also noticed us. Mr. Subhash Singh was standing
besides me. It is not true to say that, I do not recollect the questions
asked by the Subhash Singh to the accused that time. Mr. Subhash Singh
asked the accused what was he doing there, what was his duty. Mr.
Subhash Singh took me to his cabin and then asked me to keep a watch

on accused. The gate of Equipment Maintenance Department is
adjoining the cabin of Mr. Subhash Singh and car of accused was parked
outside the gate. It was a black Mahindra Scorpio. The accused was
standing near Mahindra Scorpio.
4. The Emergency Duty team responds to any emergency
situation and they are permitted to go near the center table area if the
situation arises. Emergency Duty unit usually comprises 3 to 4
members.
5. It is not true to say that, I did not see the accused at the day
of incident near the center table GPU-1389, with cloths in his hand. It is
not true to say that, I did not follow the accused to the gate of Equipment
Maintenance Department. It is not true to say that, I did not found diesel
spilling mark on the vehicle Mahindra Scorpio and the ground beneath it.
There are more than 300 vehicles in Equipment Maintenance
Department. I have seen spilled diesel many time in Equipment
Maintenance Department. It is true to say that, I did not informed about
the incident to Senior AGM Mr. Sharma. It is not true to say that, I am
deposing false today at the instance of my superiors.
