ORDER BELOW EXH. 1
The case is on today’s board. Today special drive is arranged.
Perused the record. The accused is charge-sheeted for the offence p/u/s.
85(1) of Bombay Prohibition Act.
2. Perused the record. The present matter is 5 years old. Upon
perusal it appears that, only medical report of the accused regarding the
consumption of liquor is annexed along-with charge-sheet. However, there
is no blood report on record. No blood sample is drawn and the Medico
Legal certificate is not signed by the medical officer. In view of this lacuna,
it cannot be held that the accused had consumed liquor and misbehaved in
public place for which he has has been charge-sheeted. Thus, it is apt to
stop the proceedings u/Sec. 258 of Cr.P.C.
ORDER
1. Proceedings in this case are hereby stopped u/Sec. 258 of Cr.P.C.
2. The bail amount furnished by accused is forfeited and credited to
State.
3. The NBW if any issued against accused is hereby recalled.
4. Case papers be filed.
