ORDER BELOW EXH. 1
1. Heard both the parties on the point of leniency
2. The accused along with counsel present and admitted his
guilt. The admission seems to be voluntarily. Looking to the age,
occupation and circumstances of the case by accepting plea of leniency it
would be desirable to slap amount of fine to accused to meet the ends of
justice. Since the accused No. 1 is Company and it is legal entity. Through
its Director who is CoAccused. Therefore, both of them are liable for
punishment. Hence, The following order. :
ORDER
Both the accused are held guilty for offence U/sec 85(g) Of the
Employees State Insurance Corporation Act and sentenced to pay fine of
Rs.4000/ each in default accused No. 2 shall suffer simple imprisonment
for 7 ( seven ) days.
