    Perused the complaint, verification of the complainant and
    documents annexed with complaint. Heard the learned Advocate
    Smt.Akriti Agarwal for the complainant. From the perusal of the
    record, it reveals that ECS of Rs.8,23,080/ deposited by the
    complainant to its bank i.e. ICICI Bank, Branch at Andheri got
    dishonoured vide memo dated 20.04.2019 by the accused bank with
    remark “Insufficient funds”. Notice was issued to the accused which
    is received by the accused on 09.05.2019 but the accused has not
    made payment of ECS amount within 15 days and thus cause of
    action arose on 25.05.2019. The complaint is filed within limitation
    i.e. on 14.06.2019. Hence, there are sufficient grounds to proceed
    further against the accused. Hence, issue process against the accused
    for the offence p/u/s 25(1)(c) of The Payment and Settlement
    Systems Act, 2007 read with Sec.138 of N.I. Act.
