That you accused on 13/12/2017 at about 11.00 hours at
Kalimata Seva Sangh, On Service Road opposite SRA Building, On way
towards Andheri, Western Express Highway, Jogeshwari (East),
Mumbai, drove your motor-car bearing No. MH-02-BM-8300 on a
public road, in a manner so rash or negligent as to endanger human
life, or to be likely to cause hurt or injury to any other person, and
thereby committed an offence punishable under Section 279 of the
Indian Penal Code.
Lastly, That on abovesaid date, time and place, you accused
caused grievous hurt to the informant viz., Mohammed Bilal Based Ali
Shaikh, by giving dash by your above motorcar to the informant so
rashly or negligently as to endanger human life or the personal safety of
others, due to which informant sustained simple injury and thereby
committed an offence punishable under Section 337 of the Indian Penal

JUDGMENT
The accused is present. He voluntarily pleaded guilty by
filing application. I have heard the accused. The accused is voluntarily
pleading guilt. Hence, I accept the same. Heard the accused on the
point of sentence. He prayed for leniency. Act of accused was
unintentional. He is ready to pay compensation to the victim as per
order of the court. Considering the nature of offence and submissions
of the accused, I pass the following order.
ORDER
1. The accused Srinivas Sawla Bhat is held guilty of the
offences punishable under Sections 279 and 337 of the Indian Penal

Code vide section 252 of the Code of Criminal Procedure and is
released as per section 4 of the Probation of offenders Act on his
entering into a bond in the sum of Rs. 5000/- to appear and receive
sentence whenever called upon by this Court within a period of one
year and in the mean time to keep the peace and be of good behaviour.
2. The accused shall pay compensation amount of
Rs.10,000/- (Rupees Ten Thousand only) in Court for to be paid to the
informant Mohammed Bilal Based Ali Shaikh, R/o : KEM 345/A, Janta
Colony, Near Sunni Masjid, Jhula Maidan, Bandra Plot, Jogeshwari
(East), Mumbai.
3. Copy of the order be given free of cost to the accused.
