ORDER BELOW APPLICATION FOR GRANT OF PERMISSION FOR
RE-ISSUE PASSPORT
1. This is an application of the applicant/accused
Mohammed Arif Suhel Ahmed Shaikh for permission to re-issue
passport bearing no. N-7931041 for the period of ten years from
Passport authority. He submitted that he is ready to abide by all
the conditions imposed by this Court. Hence, permission be
granted to him for re-issue of his passport for the period of ten
years from Passport authority.
2. The learned APP filed his say and objected the
application by submitting that, if an application allowed accused
will abscond and may not present for trial. Hence, he prays for
rejection of the application. I have gone through the record. The
accused is charge-sheeted for the offences punishable under
Section 325 and 504 of the Indian Penal Code
(C.C.No.2052/PW/2018, C.R.No.140/2018 of Meghwadi Police
Station). The applicant/accused is ready to abide by all the
conditions. The applicant is only seeking permission to re-issue of
his passport from the authority. Considering the nature of offences
and facts and circumstances of the case, I am of the view that no
prejudice would be caused to the prosecution, if permission is
granted to the applicant/accused for re-issue of passport for the
period of ten years from Passport authority. Hence, the order.

ORDER
1. The application is allowed.
2. Permission is granted for re-issue of passport bearing
no. N-7931041 for the period of ten years from Passport authority
to the applicant/accused Mohammed Arif Suhel Ahmed Shaikh,
subject to condition that the applicant/accused shall not leave
India without the permission of this Court and he shall attend the
Court regularly.
