ORDER BELOW EXH.1
By the order dated 27/08/2019 matter was listed for
dismissal order if complainant fails to take steps to secure the presence
of accused before the Court. Because, Court did not receive the report
till 27/08/2019 of the summons lastly issued. So today I called out
complainant as well as advocate. No one appeared. No steps taken.
Presence of complainant would not have been insisted upon if prompt
and effective steps are being taken in his absence. It is not happening.
Hence, order :
ORDER
i. Complaint is hereby dismissed u/s.256 of Cr.P.C.
ii. Accused is acquitted of the offence punishable u/s.138
of the Negotiable Instrument Act.
iii. Complaint is disposed off accordingly.
