ORDER BELOW EXH. 1
The case is on today’s board. Today special drive is
arranged. Perused the record. The accused is charge-sheeted for the
offence p/u/s. 279, 338 of the IPC r/w 134 (a)(b) of MV Act.
2. The case is more than 5 years old. Record shows that
warrants were issued against accused. However, as per police report the
accused was not found on the given address and the resident Dipak
Ahire and Hitesh Sapariya informed that they are not acquainted with
the said person as said person is no more reside in the said vicinity. The
prosecution has failed to secure his presence since long. Therefore,
considering the nature offence, the present case is a fit to stop by
invoking powers under Section 258 of the Cr.P.C.
3. Proceeding is stopped u/Sec. 258 of Cr.P.C.
4. The accused is hereby released/discharged from the case
and his bail bonds stands cancelled/cash security amount deposited by
the accused, if any, is forfeited and credited to the Government.
