STATEMENT OF ACCUSED UNDER SECTION 313 OF CR. P. C.
Name : Joheb Iliyas Khan Age : 35 years
Occu. : At present nil R/o. : Govandi, Mumbai.
(As per section 313(4)(5) of Cr.P.C., you are hereby explained that you
shall not rendered yourself liable to punishment if you refused to answer
any questions put by this Court to you in your statement under section
313 or you give false answers to them. You are also explained that you
are not bound to answer the questions which would be put to you and if
you answer those questions, your answers will be considered in evidence
along with other evidence.)
Que.1 : Have you heard the evidence and did you understand it?
Ans. : Yes.
Que. 2 : It has come in the evidence of PW No.1- Shweta Shekhar
Sharma – Cabin Executive, Air India, Noida that she know you accused.
You were her colleague. You and she were working together at Mumbai
Airport. She was Cabin executive in Air India. You accused were also
working as Cabin crew in Air India. On the day of incident, she was in
the Air India flight traveling from Mumbai to Ahmedabad. You accused
and Qatar Navare were also with her. You accused and Qatar Navre
were working as a cabin crew. In the evening you accused, Qartar and
she were boarded the plane. What do you want to say about it?
Ans. : It is false.
Que. 3 : It has further come in her evidence that she and you accused
were waiting for passengers. You accused passed comment that, your
weight is lost and hair cuts are looking good. She ignored you accused.
You repeatedly tried to show your photos in swimming costumes. You
were in brief. She asked you to stop showing the photos. Being on duty
in the flight she was helpless. You also told her that, you took her snaps.
She asked you to delete the photos. What do you want to say about it?

Ans. : It is false.
Que. 3 : It has further come in her evidence that after returning home
back, she told her husband the entire incident. Her husband called you
accused on phone. You asked him to do what he want. Her husband
reported the matter to Vakola police station. Vakola Police station asked
them to report the matter to Sahar police station. The next following
day, she lodged the report (Exh.6) to Sahar Police station. Now, report
shown to me bears my signature. Her statement (Exh.07) was recorded
before Magistrate. They have also made online complaint. She cannot
identify the mobile by which you accused tried to draw her attention to
your half naked photos, since quite a long period has been lapsed.
What do you want to say about it?
Ans. : It is false.
Que. 4 : It has come in the evidence of PW No.3- Monika D’souza –
Flight Attendant that Incident occurred on 04.05.2018 at Air India flight
No. 091 which was proceeding from Mumbai to Ahmadabad while it
was waiting for departure at Mumbai Airport. She was heading the
flight as Cabin Crew No.1 on the said flight and working in forward
galley with Ms.Mangrati who was also crew member on the flight with
her. Informant Ms. Shweta Sharma was rear crew member, working in
galley No.2 with Mr.Katar Naware and you accused who were junior
crew with Ms.Shweta Sharma. What do you want to say about it?
Ans. : It is false.
Que. 5 : It has further come in her evidence that as a senior crew
member she was responsible for briefing the crew at our office and
asking some questions regarding the air craft. At the time of briefing in
the office at Mumbai Airport all crew members except you accused were
present. After reaching the air craft she made the allocation of

responsibility. You accused came after 30 minutes of they reaching the
air craft. When she inquired about the reason about your being late, you
had no answer to that. She also asked one or two questions to you
accused about the air craft, which you was unable to answer. Hence, she
told you to study and come for the next flight. What do you want to say
about it?
Ans. : It is false.
Que. 6 : It has further come in her evidence that there was some slag
and the air craft was on the ground for more than half an hour and it
was quite hot outside and humid inside the air craft. There were many
children in the air craft who were thirsty and crying. Therefore, Ms.
Shweta Sharma came to me and asked whether we can serve the
passengers with snacks on the ground instead of serving them in air. I
permitted Ms. Sharma to distribute the snacks on ground. What do you
want to say about it?
Ans. : It is false.
Que. 7 : It has further come in her evidence that after some time
Ms.Shweta Sharma came to her and told her that you accused Zoeb was
not very happy about serving the snacks on ground and you told Ms.
Shweta that snacks should have been served in the air instead of serving
them on the ground. They served on the ground and after some time
they cleared the cabin and then flight took off and landed at
Ahmadabad. The same flight came back to Mumbai as flight No.985.
After landing of flight No.985, while they all five cabin crew were
walking towards their office at Mumbai, she was supposed to debrief
the crew again. While walking towards the office you accused Zoeb
started arguing with her on the Aero bridge. Ms. Shweta told you
accused that you are not supposed to argue with the senior most crew

members. Ms.Shweta also informed her that you were was not
attending the passengers call bell on the flight and you were showing
some videos of your swimming charms to her discomfort. You accused
then started arguing with both of them. Ms.Sweta lodged a complaint
against you accused and her statement was recorded. What do you want
to say about it?
Ans. : It is false.
Que. 8 : It has come in the evidence of PW No.4- Deepak Suresh Rathod
that Police called him at Sahar Police Station on 05.05.2018 for seizure
of a mobile, another panch Mr. Krishna was also present there. Police
seized a mobile (Article-A) from you accused in their presence and
prepared seizure panchnama (Exh-09). What do you want to say about
it?
Ans. : It is false.
Que. 9 : It has come in the evidence of PW No.5- Suschitra Kulbahadur
Mangrati that on 04.05.2018 she was working as a Cabin Crew on Air
India flight AI-901 Mumbai-Ahmadabad, flight No. AI-985 Ahmadabad-
Mumbai you accused were working as a Cabin Crew on the same flight.
On the same flight Ms. Monika D’souza was working as Senior in
forward galley and Ms. Shweta Sharma was working as a second Senior
in back galley. You accused and Mr. Atul Naware were working in the
back galley with Ms. Shweta and she was in front galley with Ms.
Monika D’souza. After landing from from AI-985 Ahmadabad-Mumbai
at Mumbai Airport, they were walking in the Airport and Ms. Monika
D’souza was giving instructions to you accused at about 09:30 p.m., that
time there was an argument between Ms.Monika and you accused,
Ms.Shweta Sharma told you accused that why you were arguing with the
senior. You accused left thereafter. Later on Shewta Sharma and Monika

informed her you accused were showing her some of your personal
pictures and also told that Shweta was looking beautiful. What do you
want to say about it?
Ans. : It is false.
Que. 10 : It has further come in her evidence that after 4 days she was
called to Sahar Police Station, it was 08.05.2018 and out statements were
recorded there. Her statement was recorded as per her assertion. What
do you want to say about it?
Ans. : It is false.
Que.11 : It has come in the evidence of PW No.6- Kavita Aniket Naik –
PSI - On 05/05/2018, she was working as PSI in Sahar Police Station.
she had registered Crime No.145/2018. The informant Sweta Sharma
had lodged report alleging therein that you accused has outraged her
modesty by showing clip of her objectionable photos. Initially, the
complaint was registered by the informant online. What do you want to
say about it?
Ans. : It is false.
Que. 12 : It has further come in her evidence that in that crime she
personally investigated the same. She called you the accused and made
inquiry with you with regard to the crime and also arrested you. After
your arrest she seized your mobile wherein the objectionable clip of
informant was there in presence of panch witness. The panchanama is
at Exh.09. Thereafter, she sought information from the Air India in
respect of the incident by writing letter dated 07.05.2011( Exh.12) to it.
In response to the said letter, the Air India has also supplied the
information along with its letter dated 07/05/2011(Exh.13). Thereafter,
she recorded the statements of eye witnesses of the incident.
Thereafter, the application was also made to the Bhoiwada Court No.7

for the purpose of recording statement of informant under section 164
of Cr.P.C. The letter dated 10/05/2018 is at Exh.14. Accordingly, the
statement (Exh.07) of informant was recorded. After completion of
investigation, there were sufficient material against you accused to
connect with the crime. Hence, the charge-sheet was filed. What do
you want to say about it?
Ans. : It is false.
Que.13 : Why the witnesses are deposing against you ?
Ans : I don’t know.

Ans. : No
