Deposition of Witness No. 03 for Prosecution.
I on solemn affirmation depose as under :
My Name : Monika D’souza
Age : 59 years Occupation : Flight Attendant
R/o. : Arvind Nagar, Building No.1, Flat No.503, behind Kalina
Police Station, Mumbai 400 029.
Exam.-in-chief by APP Shri. K. S. Jamdhade for the State:-
1. Incident occurred on 04.05.2018 at Air India flight No. 091
which was proceeding from Mumbai to Ahmadabad while it was
waiting for departure at Mumbai Airport. I was heading the flight as
Cabin Crew No.1 on the said flight and working in forward galley with
Ms.Mangrati who was also crew member on the flight with me. Ms.
Shweta Sharma was rear crew member, working in galley No.2 with
Mr.Katar Naware and accused Zoeb Khan who were junior crew with
Ms.Shweta Sharma.
2. As a senior crew member I was responsible for briefing the
crew at our office and asking some questions regarding the air craft. At
the time of briefing in the office at Mumbai Airport all crew members
except accused Zoeb were present. After reaching the air craft I made
the allocation of responsibility. Accused Zoeb came after 30 minutes of
we reaching the air craft. When I inquired about the reason about his
being late, he had no answer to that. I also asked one or two questions
to accused Zoeb about the air craft, which he was unable to answer.
Hence, I told him to study and come for the next flight.
3. There was some slag and the air craft was on the ground

for more than half an hour and it was quite hot outside and humid
inside the air craft. There were many children in the air craft who were
thirsty and crying. Therefore, Ms. Shweta Sharma came to me and
asked whether we can serve the passengers with snacks on the ground
instead of serving them in air. I permitted Ms. Sharma to distribute the
snacks on ground.
4. After some time Ms.Shweta Sharma came to me and told
me that accused Zoeb was not very happy about serving the snacks on
ground and he told Ms. Shweta that snacks should have been served in
the air instead of serving them on the ground. We served on the ground
and after some time we cleared the cabin and then flight took off and
landed at Ahmadabad. The same flight came back to Mumbai as flight
No.985. After landing of flight No.985, while we all five cabin crew
were walking towards our office at Mumbai, I was supposed to debrief
the crew again. While walking towards the office accused Zoeb started
arguing with me on the Aero bridge. Ms. Shweta told Zoeb that he is
not supposed to argue with the senior most crew members. Ms.Shweta
also informed me that accused Zoeb was not attending the passengers
call bell on the flight and he was showing some videos of his swimming
charms to her discomfort. Accused Zoeb then started arguing with both
of us. Ms.Sweta lodged a complaint against accused Zoeb and my
statement was recorded.

Cross-examination by Learned Counsel Mr. M. H. Nizam for
accused:-
5. I have taken V.R.S. from Air India. I joined Air India in

the year 1990. I do not know the date of joining of Ms. Shweta
Sharma, or accused Zoeb in Air India. I did not fly over often with
Ms. Shweta and accused Zoeb.
6. I stated to the police about the spot of incident which
occurred in the flight. I am not aware whether the flight was
getting refueled during that 30 minutes time when it was delay.
7. I stated to the police that Ms. Sweta Sharma came to
me for asking permission to serve the passengers on the ground.
The police did not ask me about the sequence of incident hence I
did not give it to the police. I took the permission from the Caption
and the Co-Pilot before taking decision of serving food to the
passengers on ground. It is not true to say that our decision of
serving food to the passengers on ground, was hazardous. It is not
true to say that accused Zoeb was disputing our decision of serving
food to the passenger on ground as we did not obtain permission
of caption and Co-Pilot. During the entire flight I had not been to
the rear galley of the flight. It is true to say that I have no personal
knowledge about the incident which took place in the rear galley
of the flight. It is not true to say that Ms.Shweta lodged police
report against the accused, as he was disputing the serving of food
while the flight was grounded. It is not true to say that today I
am deposing false.
