ORDER PASSED BELOW EXH1
Perused the record. It appears that the case is for cross
examination of the complainant. Mr.Pratik Osani, Proprietor of Ultima
Comp. Tech is present and filed application dated 03/03/2021 for
permission to withdraw the complaint stating therein that the
complainant and accused have amicably settled the case for
Rs.16,00,000/ and complainant has no intention and willingness to
continue with the case. Considering the application, sufficient grounds
are available for permitting to the complainant to withdraw the
complaint. Hence, following order is passed :
ORDER
(i) The application dated 03.03.2021 for withdrawal of the complaint
is allowed.
(ii) The complaint is hereby permitted to be withdrawn as disposed of
as per section 257 of the Criminal Procedure Code.
(iii) The accused are acquitted in view of the compounding the offense.
(iv) Court fee stamps, if any, be refunded on demand only as per rules.
