Matter is taken up in today’s special drive. Today also
complainant and advocate are absent. Perusal of roznama and record
shows that matter is pending for securing presence of accused since
long. Till date no effective steps are taken by the complainant to secure
presence of accused, despite several opportunities. This conduct of the
complainant itself is sufficient to show it’s loss of interest and total
disregard. In these circumstances, there is no alternative than to dismiss
the matter. Hence, the complaint is dismissed for want of prosecution
under Section 256 of Cr. P.C. Accused No.2 is acquitted for the offence
punishable under Section 138 of N.I. Act. Proceeding stands closed.
