Deposition of Witness No. 05 for Prosecution.
I on solemn affirmation depose as under :
My Name : Shabana Jafar Khan
Age : 44 years Occupation : Housewife
R/o. : Room NO. 3, Shashikala Chawl, Chimatpada, Marol,
Andheri East, Mumbai.
Exam.-in-chief by APP Mr. K. S. Jamdhade for the State:-
1. The incident occurred in the year 2017 at about 09:30
A.M., at the house of Rehmat. I went to drop kids of Rehmat to her
home from the school, as my friend Nisha requested me to do so on a
phone call. When I reached the house of Rehmat, there was ongoing
dispute between Rehmat and her neighbors on the count of cleaning the
courtyard. Mr. Thakur i.e. Neighbor of Rehmat was abusing her. As the
children were getting scared I took them inside the house. When I tried
to intervene, the accused continued hurling abuses. Police recorded my
statement. I can identify the accused. He is present before Court today.

Cross-examination by Learned Counsel Mr. B. S. Chavan for
accused:-
2. I did not state to the police while recording statement
that, my friend Nisha requested me to brought the kids of Rehmat
at her home from school. It is not true to say that, as I never
received any call from Nisha, I did not state this fact to the police. I
know Rehmat from 12 to 13 years. It is true to say that, Rehmat
was my good friend. I am not aware whether Kadam Wadi is 4 Km

away from Chimatpada. It is not true to say that, police recorded
my statement on 15.01.2018. It is not true to say that, I was not
present at the time of incident and I did not witnessed anything. It
is not true to say that, police did not record my statement on the
day of incident. It is not true to say that, Rehmat requested me to
give statement. It is not true to say that, today I am deposing false
to support Rehmat.
