I hereby state on solemn affirmation,
Name: Anuj Surendrakumar Sekhsaria, Age: 46 years,
Occupation : Business, R/o. Prabhadevi, Mumbai.
[ Accused obtained exemption from personal attendance (Exh.12)
without challenging his personal identity through his Advocate Harish
Shetty. Therefore, evidence recorded in absence of accused.]
Examination-in-chief by the Ld. APP for State
On 03/03/2017 I had along-with others taken the death
body of Jitendra Jain who happened to be the deceased husband of my
sister Shilpa Jain. The death body was brought at Saurashtra Society
Gulmohar Road at 4.00 a.m. Rahul Saxeria was my cousin brother.
Rohit Saxeria is also my cousin brother and Payal happens to be his
wife. We all were present at Saurashtra society. We came downstairs on
the ground at about 5.15 a.m. Rahul booked a Uber Vehicle to go his
home located at Malad. Said vehicle was gray coloured Wagon-R
vehicle. He sat in the vehicle. The driver of the vehicle took U-turn and
took the vehicle on main road. We all heard a loud accident sound. We
rushed to the place. We found that Rahul’s vehicle was hit by blue
coloured construction dumper which was bearing No. 7314. We drew
out the Rahul from the Uber car while he was sitting at the back seat.
He was in the pool of blood having injuries at his backside of the head
and other body parts. We called police and took injured Rahul to
Cooper Hospital but, he was declared dead before reaching the hospital.

I reported the matter to Juhu P.S. Now FIR from record is shown to me.
It is the same. It bears my signature. Contents therein are true and
correct. It is marked at Exh.14. I had not seen the driver of the dumper
as he left the place before we reached the spot.

2. Rahul’s widow Preeti received compensation claim in
respect of this accident.
