ORDER BELOW APPLICAION FILED BY ACCUSED/APPLICANT
FOR PERMISSION TO GO ABROAD
The applicant filed the present application. Applicant is
accused, against whom crime is registered with Sakinaka police station for
the offence P.U.S. 324, 504, 506 ¼ii½ r/w. 34 of Indian Penal Code.
Applicant/accused submitted that, he is desired to go abroad i.e. at Saudi
Arabia from 19/08/2018 to 10/09/2018 for the purpose of HUJ. He is
ready to abide by terms and conditions in respect of permission to go
abroad, if allowed. Hence, he prayed for permission to go abroad.
2. Heard Ld. Advocate Mr. Sunil Gharge for accused. In support
of the application applicant have filed his affidavit on record. It is at
(Exh.3 ). Applicant have also file copy of his Aadhar Card and PAN Card,
to support of his application. Investigation Officer have filed his say to
raise his objection to grant permission to applicant to go to abroad. It is at
(Exh.4 ). After going through the record, in my view the prosecution will
not suffer any hardship, if permission to go abroad to applicant/accused
granted. Therefore, in the interest of justice and for the reasons
mentioning application, I proceed to pass following order.

ORDER
1 The application of applicant/accused viz. Nayyum Saheb Kha
Pathan, for permission to go abroad, is hereby allowed on
following conditions.
a The applicant/accused is permitted to go abroad i.e at Saudi
Arabia from 19/08/2018 to 10/09/2018 for the purpose of
HUJ on surety bond or in like cash amount of `.15,000/ .
b The applicant/accused shall furnish his undertaking that, he
will remain present before court, as and when required.
c The applicant/accused shall furnish all the details of his stay
in abroad with his all details and also the place and address
alongwith phone numbers, at which he will stay in abroad to
Investigation Officer.
d The applicant/accused shall submit verified copy of his
Passport and other relevant documents with the Investigation
Officer.
e On his returning the applicant/accused shall inform the
Investigation Officer, accordingly.
