ORDER BELOW APPLICATION FILED BY ACCUSED
Perused the application and reply filed by A.P.P. Heard
learned defence counsel Shri. Akhilesh K. Dubey for applicant/accused
and Learned APP Mrs. N. R. Pasarkar.
2. By this application, the applicant/accused viz. Firoz Abdul
Majid Hawaldar is seeking permission to go abroad to visit Hongkong
and China from 5/4/2019 to 20/04/2019 for business trip and will stay
in Hotel Holiday In. He further contended that his aforementioned
period be accordingly allowed and he is ready to abide by the conditions
imposed by the Court. Hence the application supported by affidavit.
3. Learned APP has opposed the present application.
4. Heard both side. Perused the record.
5. Considering submission made before me, perusal of
application supported by documents, nature of case and the fact that he
is permitted to go abroad to visit Hongkong and China from 5/4/2019
to 20/04/2019 for business trip mentioned in the application and

charge-sheet is filed, though upon certain conditions. I find that upon
certain condition the application may be allowed. Hence, the following
order.
ORDER
1. The applicant/accused is permitted to go abroad to
visit Hongkong and China from 5/4/2019 to 20/04/2019 for business
trip on cash security of Rs.30,000/-.
2. The applicant/accused shall also authorise his
counsel to appear on his behalf and to do all necessary acts in the
progress of the case and will give an undertaking that his counsel will
not seek any adjournment in the case pending before the court below.
The petitioner shall also produce his passport as and when required by
the court.
3. In case the applicant/accused furnishes security and
comply the above conditions, a permission in the form of 'no objection
certificate' to the applicant/accused in the pending criminal case to go
abroad. This permission in the above form, shall be subject to the
issuance of Passport, Visa and other necessary formalities, if any, to go
abroad.
