The present complaint case on hand came to be filed under
Section 447, 448, 451, 452, 454 r/w. 34 of the Indian Penal Code.
Having gone through the roznama and case papers, it appears
that the complainant is absent since long time. Moreover, no positive step
was taken by the complainant within a span of last two years. Though the
complainant is represented by the advocate or by the officer conducting the
prosecution, yet neither the complainant nor the advocate appeared before
the Court since long time. Thus, this case is unattended. In such
circumstances, it appears that the case comes within the ambit of stale and
ineffective case. Hence, having regard to the pendency of the case, it is
required to be disposed of in the Special Drive. Resultantly, I pass the
following order:
ORDER
i] The case is dismissed for want of prosecution.
ii] The accused are acquitted from the offence levelled in this complaint.
iii] The case be closed accordingly.
