The accused, Druv Arun Bhandari, Age – 25 Years, R/o. Flat No.211/212,
Wing – I, Tarapor Garden Co.Op.Hou. Society Limited, New Link Road, Oshiwara,
Andheri(W), Mumbai is alleged to have consumed Narcotic Drug/ Psychotropic
Substances on 26/12/2017 at about 10.30 hrs. on footpath, near Ankita Tower,
S.V.P.Nagar, Char Bangala, Andheri (W), Mumbai.
2. Today the accused is present with his advocate and filed application for
plead guilty. The accused further prayed to show lenient view while imposing the
punishment.
3. Having gone through the record, it appears that the accused has
voluntarily pleaded guilty. According to him, he is sole earning member of his poor
family. Hence, considering the age of the accused, his responsibility towards his family
and the nature of offence, the following order would meet the ends of the justice:
ORDER
i] The accused, Druv Arun Bhandari, is hereby convicted for the offence punishable
under section 8 (C) r/w. 27 of the Narcotic Drugs and Psychotropic Substances
Act as per Section 275 of the Bharatiya Nagarik Suraksha Sanhita.
ii] The accused is sentenced to pay fine of Rs.5,000/- (Rupees Five Thousand Only).
In default of payment of fine, he shall suffer simple imprisonment for seven days.
iii] Copy of the judgment/order be given free of cost to the accused.
