ORDER BELOW APPLICAION FILED BY ACCUSED/APPLICANT
FOR PERMISSION TO GO ABROAD
The applicant filed the present application. Applicant is
accused, against whom crime is registered with Powai police station for
the offence P.U.S. 498 ¼A½] 377, 323, 504, 506 r/w. 34 of Indian Penal
Code. Applicant/accused submitted that, he is desired to go abroad i.e. at
Oman from 15/04/2018 till 14/04/2019. He is ready to abide by terms
and conditions in respect of permission to go abroad, if allowed. Hence,
he prayed for permission to go abroad.
2. Heard Ld. Advocate Mr. M. R. Ragnekar for accused. In
support of the application, applicant have filed his affidavit on record. It
is at (Exh.3 ). In support of his application applicant have filed Copy of
his Aadhar Card, Copy of vehicle driving licence issued by Sultanate of
Oman, Copy of his Passport issued by Indian Government, Copy of bail
order dtd. 23/03/2017, Copy of order dtd. 12/04/2017 for permission to
go abroad, Copy of receipt dtd.13/04/2017.
3. Investigation Officer have filed his say and is not having
objection to grant permission to applicant to go to abroad.
4. After going through the record, in my view the prosecution
will not suffer any hardship, if permission to go abroad to

applicant/accused granted. Therefore, in the interest of justice and for the
reasons mentioning application, I proceed to pass following order.
ORDER
1 The application of applicant/accused viz.Amjad Abdul Majid
Jiwani, for permission to go abroad, is hereby allowed on
following conditions.
a The applicant/accused is permitted to go abroad i.e. at Oman
From 15/04/2018 till 14/04/2019 on surety bond or in like
cash amount of `.50,000/ . (If applicant previously furnished
cash amount in lieu of surety bond, it be considered, as same
for present application).
b The applicant/accused shall furnish his undertaking that, he
will remain present before court, as and when required.
c The applicant/accused shall furnish all the details of his stay
in abroad with his all details and also the place and address
alongwith phone numbers at which he will stay in abroad to
Investigation Officer.
d The applicant/accused shall submit verified copy of his
Passport and other relevant documents with the Investigation
Officer.
e On his returning the applicant/accused shall inform the
Investigation Officer, accordingly.
f The accused/applicant shall report his arrival and depature.
