This is the complaint filed under Section 138 r/w. 34 of the Negotiable
Instruments Act. The accused and the complainant appeared before this Court
with their learned advocates. The matter was referred for mediation as per
the request of the accused and complainant. The matter was settled in the
mediation. So also, during the pendency of the case, the complainant filed
pursis submitting that both the parties have been settled their dispute out of
Court. The complainant further submits that he does not want to proceed
further with this matter. Thus, it appears that, the matter is amicably settled
between both the parties. Hence, I pass the following order:
ORDER
(i) The application for withdrawal of the complaint is
allowed.
(ii) The complaint is hereby permitted to be
withdrawn as disposed off.
(iii) Court fee stamps, if any, be refunded on demand
only as per rules.
(iv) The case be closed accordingly.
