ORDER BELOW EXH.1 (PART HEARD)
This is the complaint filed under Section 138 r/w. 142 of N. I.
Act. During the pendency of the case and after filling the affidavit in
lieu of evidence, the complainant filed application (Exh.No.15) for
permission to withdraw the complaint as the matter is settled between
both the parties. The complainant submits that the complainant has
received the entire amount of dishonoured cheque. The complainant
further submits that it does not want to proceed further with this
matter. Thus, it appears that, the matter is amicably settled between
both the parties. In view of the order passed below Exh.No.15, I
proceed to pass the following order:
ORDER
(i) The application for withdrawal of the
complaint is allowed.

(ii) The accused is hereby acquitted from the
offence punishable under section 138 r/w. 142
of the Negotiable Instruments Act. Bail bond
furnished by the accused stands cancelled.
(iii) The original documents i.e. cheque and other
documents, if filed on record, be returned to
the concerned party.
(iv) Court fee stamps, if any, be refunded on
demand only as per rules.
(v) The case be closed accordingly.
