ORDER BELOW EXHIBIT NO. 61
By way of this application, accused has prayed to correct the order dated 20/04/2023 passed below Exh. 23 through which application filed by the accused for sending disputed document for handwriting expert was allowed. As per case of accused that document is in the handwriting of complainant and hence handwriting of complainant was to be examined by comparing with his specimen handwriting and other admitted handwriting. However, in operative order passed below Exh. 56, I have mentioned specimen handwriting of accused be sent to handwritten expert in order to compare it with the disputed handwriting on the chit. Therefore, operative order passed below Exh. 56 needs to be corrected and it should be read as under:-
1] Application at Exh. 56 is allowed.
2] Disputed document at Article-A along with Specimen handwriting of complainant and other admitted handwriting of accused be sent to handwriting expert in order to examination and to ascertain whether handwriting on disputed note at Article-A is of the complainant.
