22nd COURT, ANDHERI, MUMBAI.
ORDER BELOW EXH-1 IN C.C. NO. 1358/PS/2019
1) This is a summons case instituted otherwise than upon
a complaint. Perused the record & proceedings of this case.
Offence U/sec. 122(c) of the Maharashtra Police Act is dated
06.03.2019. Since, long the case is pending for securing presence
of accused. The prosecution could not secure the presence of
accused despite repeated warrants being issued.
2) Considering the nature of the offence and the
punishment provided for the offence, no purpose will be served in
keeping the case pending on board.
3) Hence, this Court is constrained to stop the
proceedings under Sec. 258 of Cr. P. C. In result, the following
order is passed.
ORDER
1. The proceeding is stopped vide Section 258 of Cr.P.C. &
the accused is discharged of the offence charged against him.
2. Bail bonds of the accused stands cancelled.
3. Seized muddemal being worthless be destroyed after
appeal period as per law.
