ORDER BELOW EXH. 1
Perused record. The complainant has prayed for issuing
direction to police vide Section 156(3) of the Code of Criminal Procedure
for investigation of the offences punishable under Sections 170, 406, 409,
420, 465, 468, 471, 504, 506, 34 of the Indian Penal Code. Record shows
that the complainant and his advocate did not attended the court after
the year 2016. The complainant side failed to argue. It seems that the
complainant has lost interest in the matter. The case is pending since last
five years without any progress in it. I have gone through the record.
Considering the nature of allegations and record of the case, I do not find
it fit to issue direction of investigation as prayed by the complainant.
Hence, prayer of direction of investigation under Section 156 (3) of the
Code of Criminal Procedure is rejected. There are no sufficient grounds
of proceeding. Hence, the complaint is dismissed vide Section 203 of the
Code of Criminal Procedure. Proceeding is closed.
