The applicant(accused) is seeking custody of I Phone 6S
Apple & RBDMI 5 mobile (described in para 1 of the application).
The applicant submitted that police has seized above said
property. Now the above said property is lying in the police station, and
therefore, he is seeking custody.
The Investigating Officer and Ld APP has also filed their
say and they have strongly objected for the same.
Perusal of record, it shows that present applicant is accused
in the said crime, which is registered U/Sec.354(d) etc of Indian Penal
Code. It means case property is nothing but evidence of said crime.
Under such situation, applicant accused is not entitled to get recovery of
the same, at this stage. Therefore, I proceed to pass the following
order in the interest of justice.:
