ORDER BELOW APPLICAION FILED BY ACCUSED/APPLICANT
FOR PERMISSION TO GO ABROAD
The applicant filed the present application. Applicant is
accused, against whom crime is registered with Sakinaka police station for
the offence P.U.S. 324, 323 r/w. 34 and 280, 269, 270 of Indian Penal
Code. Applicant/accused submitted that, he is desired to go abroad i.e. at
Saudi Arabia from 01/04/2018 to 30/04/2018 to perform religious
ceremony of Umrah. He is ready to abide by terms and conditions in
respect of permission to go abroad, if allowed. Hence, he prayed for
permission to go abroad.
2. Heard Ld. Advocate Mr. Akram Khan for accused. In support
of the application applicant have filed his affidavit on record. It is at
(Exh.3 ). In support of his application applicant have filed Copy of Ration
Card, Copy of Election ID, Copy of his Aadhar Card, Copy of his PAN Card,
Copy of driving licence. Investigation Officer have filed his say and
thereby raised his objection to grant permission to applicant to go to
abroad. After going through the record, in my view the prosecution will
not suffer any hardship, if permission to go abroad to applicant/accused
granted. Therefore, in the interest of justice and for the reasons
mentioning application, I proceed to pass following order.

ORDER
1 The application of applicant/accused viz.Mohammad Islam
Noor Mohammad Ghoudhary, for permission to go abroad, is
hereby allowed on following conditions.
a The applicant/accused is permitted to go abroad i.e. at Saudi
Arabia from 01/04/2018 to 30/04/2018 to perform religious
ceremony of Umrah on surety bond or in like cash amount of
`.15,000/ .
b The applicant/accused shall furnish his undertaking that, he
will remain present before court, as and when required.
c The applicant/accused shall furnish all the details of his stay
in abroad with his all details and also the place and address
alongwith phone numbers, at which he will stay in abroad to
Investigation Officer.
d The applicant/accused shall submit verified copy of his
Passport and other relevant documents with the Investigation
Officer.
e On his returning the applicant/accused shall inform the
Investigation Officer, accordingly.
