ORDER BELOW APPLICAION FILED BY ACCUSED/APPLICANT
FOR PERMISSION TO GO ABROAD
The applicant filed the present application. Applicant is
accused, against whom crime is registered with Powai police station for
the offence P.U.S. 419, 420, 465, 467, 468, 471, 120 (B) of Indian Penal
Code r/w. 19 of Human Organ Transplantation Act, 1994.
Applicant/accused submitted that, he is desired to go abroad i.e. at Europe
from 12/06/2018 to 11/12/2018 to attend the conference of profession.
He is ready to abide by terms and conditions in respect of permission to go
abroad, if allowed. Hence, he prayed for permission to go abroad.
2. Heard Ld. Advocate Mr. M. R. Rangnekar for accused. In
support of the application applicant have filed his affidavit on record. It is
at (Exh.3 ). In support of his application applicant have filed Copy of his
Aadhar Card, Copy of bail receipt dtd.27/03/2017, Copy of order passed
on 23/03/2017 in C.C. No. 216/N/2017. Ld. A.P.P. have filed his say and
is having no objection to grant permission to applicant to go to abroad, on
the ground that, accused asking permission for limited period. After
going through the record, in my view the prosecution will not suffer any
hardship, if permission to go abroad to applicant/accused granted.
Therefore, in the interest of justice and for the reasons mentioning
application, I proceed to pass following order.

ORDER
1 The application of applicant/accused viz. Dr. Mukesh Jethalal
Shah, for permission to go abroad, is hereby allowed on
following conditions.
a The applicant/accused is permitted to go abroad i.e. at Europe
from 12/06/2018 to 11/12/2018 to attend the conference of
profession, on surety bond or in like cash amount of
`.50,000/ . (If applicant previously furnished cash amount in
lieu of surety bond, it be considered, as same for present
application).
b The applicant/accused shall furnish his undertaking that, he
will remain present before court, as and when required.
c The applicant/accused shall furnish all the details of his stay
in abroad with his conference details and also the place and
address alongwith phone numbers at which he will stay in
abroad to Investigation Officer.
d The applicant/accused shall submit verified copy of his
Passport and other relevant documents with the Investigation
Officer.
e On his returning the applicant/accused shall inform the
Investigation Officer, accordingly.
