Perused application and say filed by learned APP.
Heard both sides.
2. This is an application filed by informant and
accused vide Section 320(2) of Code of Criminal Procedure (in
short Cr.P.C.) for permission to compound the offence.
3. Both informant and accused contended that their
dispute has been settled out of the Court and the informant does
not want to proceed further with the complaint. He want to
compound the case.
4. Perused record. The accused is facing the trial for
the offence punishable under Sections 406 and 417 of I.P.C. The
charge for the offence punishable under Section 406 and 417 of
I.P.C. has been recorded. Witness summons is duly served upon
informant. He is present before the Court. He has submitted that
the accused handed over the entrusted property i.e. voice
recorder and five mikes to him and the dispute between them is
settled out of the Court.
5. Section 406 and 420 of I.P.C. are compoundable
with the permission of the Court as per Section 320(2) of Cr.
P.C. The owner owner of property in respect of which criminal
breach of trust has been committed and the cheated person i.e.
informant himself want to compound the offences charged
against accused. The dispute between the parties is amicably
settled out of the Court and the informant received his property.

Thus, considering the settlement between informant and
accused, it is necessary to grant permission to compound the
offence. Hence, the application deserves to be allowed. With
this, I pass following order :
ORDER
1. Application is allowed.
2. Permission is granted to the informant and the accused to
compound the offences punishable under Sections 406
and 420 of I.P.C. vide Section 320(2) of Cr. P.C.
