ORDER BELOW EXH. 1
Perused the record. Read complaint and verification
statement of the complainant. The complainant has prayed to issue
process against the accused for the offences punishable under Sections
182 and 384 of the Indian Penal Code. I have also gone through the
inquiry report filed by the police under Section 202 of the Code of
Criminal Procedure, according to which no offence took place. I have
considered the submissions of learned advocate for the complainant.
After going through the record the dispute between the parties seems to
be only relating to business transaction. There is nothing to show that
the proposed accused committed the offence of extortion. So far as
offence punishable under section 182 of the Indian Penal Code is
concerned, there is bar of taking cognizance under section 195 of the
Code of Criminal Procedure. Therefore, considering the record I am of
the opinion that there are no sufficient grounds of proceeding. Hence,
the complaint is dismissed vide Section 203 of the Code of Criminal
Procedure. Proceeding is closed.
