This is the complaint filed under Section 138 of N. I. Act. The accused
did not appear before this Court. During the pendency of the case, the
complainant filed application (Exh.No.5) for permission to withdraw the
complaint interalie submitting that he received Rs.1,00,000/ from accused as
full and final settlement amount against the disputed cheque. The
complainant further submits that he does not want to proceed further with
this matter. Thus, it appears that, the matter is amicably settled between both
the parties. In view of the order passed below Exh.No.5, I proceed to pass the
following order:
ORDER
(i) The complaint is hereby permitted to be
withdrawn as disposed of as per section 257 of the
Criminal Procedure Code.
(ii) Court fee stamps, if any, be refunded on demand
only as per rules.
(iii) The bail bonds furnished by the accused stand
cancelled.
(iv) The case be closed accordingly.
