ORDER BELOW APPLICATION FILED BY ACCUSED
Perused the application and reply filed by A.P.P. Heard
learned defence counsel Shri. Satish Ghorpade for applicant/accused and
Learned APP Mrs. N. R. Pasarkar.
2. By this application, the applicant/accused viz. Mr. Mohd.
Salim Rehmatullah is seeking permission to go abroad to Saudi Arabia,
Iran, Dubai, Afghanistan, China for business purpose from 1/03/2019
to 01/03/2020. He further contended that his aforementioned period be
accordingly allowed and he is ready to abide by the conditions imposed
by the Court. Hence the application supported by affidavit.
3. Learned APP filed her say contending therein that applicant/
accused be directed to provide detail address of his stay in abroad and
if allowed to go abroad, the trial will hamper.
4. Heard both side. Perused the record.

5. Considering submission made before me, perusal of
application supported by documents, nature of case and the fact that he
is permitted to go abroad to Saudi Arabia, Iran, Dubai, Afghanistan,
China for business purpose from 1/03/2019 to 01/03/2020 as
mentioned in the application and chargesheet is filed, though upon
certain conditions. I find that upon certain condition the application
may be allowed. Hence, the following order.
ORDER
1. The applicant/accused is permitted to go abroad
viz. to Saudi Arabia, Iran, Dubai, Afghanistan, China for business
purpose from 05/04/2019 to 01/03/2020 on cash security of Rs.30,000/
2. The applicant/accused shall also authorise his
counsel to appear on his behalf and to do all necessary acts in the
progress of the case and will give an undertaking that his counsel will
not seek any adjournment in the case pending before the court below.
The petitioner shall also produce his passport as and when required by
the court.
3. In case the applicant/accused furnishes security and
comply the above conditions, a permission in the form of 'no objection
certificate' to the applicant/accused in the pending criminal case to go
abroad. This permission in the above form, shall be subject to the
issuance of Passport, Visa and other necessary formalities, if any, to go
abroad.
