The accused is alleged to have committed the offence punishable
under section 142 of Maharashtra Police Act. This is a summons case instituted
otherwise than upon complaint.
2. Having gone through the roznama and case papers, it appears that the
case is fixed for appearance of the accused. The case is pending since last eleven
years. Moreover, no positive step was taken by the prosecution to secure the
presence of the accused within a span of last eleven years. Thus, it seems that this
case is unattended since long time. Hence, it would not be appropriate to keep the
matter pending unnecessary without any progress. In short, the record shows that
this case comes within the ambit of stale and ineffective case and no purpose will be
served by keeping the case on record. Hence, having regard to the pendency of the
case, it is required to be disposed of in the today’s Special Drive. Resultantly, I pass
the following order:-
ORDER
i] The proceeding in this case is stopped under section 258 of the Code of
Criminal Procedure and the accused is discharged.
ii] Bail bonds of the accused stands cancelled.
iii] Seized muddemal being worthless be destroyed after appeal period as per
law.
iv Cash bail be forfeited and be credited to State Government/Surety be
discharged.
