SUM. CRI. CASE NO. 684/SS/2018
Read complaint, perused affidavit of verification of
the complainant and also gone through the documents produced
on record. Heard the learned advocate on behalf of the
complainant. It appears that this complaint is filed within the
period of limitation. Accused no. 1 is the company whereas
accused no.2 and 3 are the Directors of the said company. As per
the contentions raised in the complaint, the disputed cheque is
issued on behalf of accused no.4 who is the proprietor of
proprietory concern as mentioned in the complaint. By way of
application at Exh.9 complainant has prayed for the issuance of
the process against accused no.4 only being the signatory of
disputed cheque. Further, the documents produced on record
and from the affidavit of the verification of the complainant, it
appears that there is sufficient ground to proceed against the
accused No.4 under section 138 of the Negotiable Instruments
Act. Hence, I pass following order:-
O R D E R
Issue process against accused No.4 under Section
138 of Negotiable Instruments Act, R/o. 05/05/2020
at 2.45 p.m.
