COMMITTAL ORDER
The verbatim reproduction of the order of the Hon’ble Session
Court is as under :
“None present for applicant.
PP Mr. J. V. Desai for the State/respondent is present.
Applicant in Jail. Perused papers. Heard Ld. APP. POCSO SPL
Case No.514/2018 be transferred to from Ld. Sessions Court
Dindoshi Court No.29 and be tagged with POCSO SPL Case
No.17/2019. The Jail Authorities to produce accused in Cr.
No.412/2018, Case No.PW/403/2019 before the 63rd M.M.
Court, Andheri and the Ld. Magistrate is requested to commit
the trial and same be placed for committal to Court No.29 for
disposal as per law. Inform concerned courts, Jail Authorities
and Ld. MM Court. Secretary, DLSA to provide legal aid for
purpose of the and other reliefs as prayed for in the application.
POCSO MA No.1441 of 2022 is accordingly disposed off.”
Mohammed Badshah Shaikh S/o. Mohammed Salim Shaikh
(Accused) is produced before me through Video Conference. Accused
submitted that he is represented by an advocate. He is charged with
offence punishable under Section-363 of the Indian Penal Code. The
Copies of police report and documents as specified under Section-207 of
the Code of Criminal Procedure have been served to the accused through
his advocate. In view of the order of the Hon’ble Session Court the case is
committed to the Hon’ble Session Court. With this, I pass following order:

ORDER
1] The case be committed to the Court of Session.
2] Accused is remanded to Magisterial Custody until commitment of
the case and also during and until conclusion of trial before the
Court of Session vide Section-209(a) and (b) of the Code of
Criminal Procedure.
3] Jail Authorities are directed to produce accused before the Court of
Session on receiving production warrant from that court in Form
No.IV, Chapter-XXIII of the Criminal Manual.
4] Police Station Officer, D.N. Nagar Police Station be directed to
produce muddemal property, if any, in the Court of Session on or
before 29/12/2022 positively.
5] The Public Prosecutor shall be notified of the commitment of the
case to the Court of Session.
