Both the parties are present alongwith their respective ld.
advocates before the court. Complainant Nimisha is present before the
court alongwith her advocate. She wants to withdraw the present
complaint as compromised between parties took place out of the court.
Present complaint is filed for the offence punishable under sections
498A, 406, 500 and 506 (ii) of Indian Penal Code etc. In view of order
passed by my ld. Predecessor, inquiry report under section 202 of Code
of Criminal Procedure is called. Yet, order of issuance of process is not
passed against proposed accused. In view of withdrawal puris Exh.6,
complainant wants to withdraw the complaint. Withdrawal pursis Exh.6
is accepted after due verification. Therefore, I find no sufficient grounds
to proceed further against proposed accused. Hence, the complaint
needs to be dismissed. In this view of matter, I proceed to pass following
order:
O R D E R
1. Complaint stands dismissed as per section 203 of Code of
Criminal Procedure.
2. Proceeding be closed.
