PARTICULARS OF THE OFFENCE -
I, Hashmi H.A.H.I., hereby charge you accused as follows:
That you accused on 24.05.2018 at 10.45 hrs., to 11.00
hrs., near P. V. Jewellers, J.B. Nagar, Andheri (E), Mumbai drove a
Motorcar bearing no. MH-04-BN-5490 possessed by you on a
public way in a manner so rash or negligent as to endanger human
life or to be likely to cause hurt to the informant as well as witness
and thereby committed the offence P/U/Sec.279 of the IPC.
On abovesaid date, time and place, you accused drove
Motorcar bearing no. MH-04-BN-5490 possessed by you on a
public way in a manner so rash or negligent as to endanger human
and caused grievous hurt to the informant on his left hand finger
and neck and thereby committed offence P/U/Sec.338 of the IPC.
On above said date, time and place, you accused without
providing medical aid to the informant as well as without
informing to the police fled away from the spot and thereby
committed an offence punishable U/Sec. 134(A)(B) of M.V. Act
and within my cognizance.
PLEA OF THE ACCUSED.

JUDGMENT
Accused has filed application and voluntarily pleaded
guilty. The offences alleged against accused are P/U/sec.279,338
of the IPC r/w. 134(A)(B) of M.V. Act. Therefore, considering the
nature of offence the plea of accused is accepted and I proceed to
pass the following order:-
O R D E R
1) Accused is convicted for the offence P/U/Sec.279 of IPC
as per sec. 252 of Cr.P.C and he is sentenced to pay fine of
Rs.1000/- (Rs. One Thousand Only) in default to suffer simple
imprisonment for five days.
2) Accused is convicted for the offence P/U/Sec.338 of the
IPC as per sec. 252 of Cr.P.C and he is sentenced to pay fine of
Rs.1000/-(Rs. One Thousand Only) in default to suffer simple
imprisonment for two days.
3) Accused is convicted for the offence P/U/sec. 134(A)(B)
of M.V. Act as per sec. 252 of Cr.P.C and he is sentenced to pay fine of
Rs.500/-(Rs. Five Hundred Only), in default he shall suffer SI for
five days.

4) Accused is directed to pay compensation to the injured
persons viz. 1, Informant - Pradeep Shrirang Lokhande Rs. 3,000/-
and Witness- Juber Ahmed Shaikh Rs. 3,000/- total Rs. 6,000/-.
5) J.C. is directed to issue letter to the injured person for
claiming the compensation amount.
6) Case is disposed off accordingly.
