I hereby state on solemn affirmation,
Name: Twinkle Winson Thomas, Age: 27 years,
Occupation : Professional Hair Stylist, R/o. Virar (W).
Examination-in-chief by the Ld. APP for State
In 2017 I was residing at Jogeshwari (E) in a MHADA bld.,
behind Balasaheb Thakare Hospital. I was having my account on
facebook with identity ‘twinklethomas’ and my profile was having my
own picture.
2. On 04/08/2017 I received facebook friend request with
name Jenny D’Souza which appeared to be a female and profile picture
of said account was of a female. I accepted said facebook friend request.
For one or two months I was talking on facebook messenger with said
facebook account and it appeared to me that a girl was talking to me.
Suddenly on one fine day I received a video call from facebook account
on which a person on other side of the call showed private part with
back camera. I disconnected the call immediately. I decided to show
said person the consequences of his wrong deed and therefore, I
decided to teach him lesson. Thus, I started to talk again nicely and
contact numbers were exchanged. Then we started to chat on whatsapp.
During chats I came to know that said person is male person. We started
to talk with each other like normal girl and boy. I had informed these
facts to my parents as well as Sagar Suresh Lokhande to whom I was
proposed to be engaged. Then it was decided that we will meet at
Kandivali. He decided a location near Saloon at Kandivali. We were
talking on phone. However, he did not showed up as he saw me with

few other persons who were Sagar and my two other friends.
Thereafter, I lodged the complaint. Now FIR from record is shown to
me. It is the same. It bears my signature. However, I do not recollect its
contents.
3. I gave the printouts of screenshots of facebook and
whatsapp chats to polcie after filing of report. It were collected by
police and panchnama was drawn. I also gave certificate in respect of
screenshots taken by me. Now panchanama is shown to me. It is the
same. It bears my signature. Contents therein are true and correct. It is
marked at Exh.9. The certificate tendered by screenshot printouts. Now
it is shown to me. It is the same. It bears my signature. Contents therein
are true and correct. It is marked at Exh.10. I have signed each page of
the screenshots. It were around 81 pages. It is true and correct as per
chats in my facebook messenger and whatsapp.
4. It did happen that the contact number to whom I was
talking on that day at Thakur Complex, Kandivali (E), was 7021669170.
It did not happen that on 09/11/2017 at Thakur Complex Kandivali (E)
at around 6.15 p.m. myself, Sagar and my two friends have caught the
accused before the Court and beaten him up.

5. It is true to say that the number on which I was chatting on
whatsapp was 8424806130. I deny that on 09/11/2017 at Thakur
Complex Kandivali (E) at around 6.15 p.m. myself, Sagar and my two
friends have caught the accused before the Court who was wearing
black shirt and blue geans and beaten him up. It did not happen that we
caught accused before the Court and he ran away after we beat him and

therefore, after two days I went to police station to lodge the report. It
is true that myself and accused have settled the matter. It is not true to
say that therefore, today I have deposed false.
Cross-examination by Ld. Advocate Rinky Agarwal on behalf of accused
6. I am not good in reading Marathi language. I admit that I
have mentioned the name of the person who was chatting with me on
whatsapp and facebook messenger at the time when I lodged FIR. I
admit that apart from his sexual identity as male I was not knowing
anything about that person. I admit that I have signed the panchanama
on the instructions of police. I admit that I have put the signature on
certificate as police asked me to do so. I deny that the printouts of the
screenshots are not original but, the edited one. I have not seen the face
and identity of the person on the video call.
7. I admit that I have settled the dispute with accused and
accepted Rs. 1,00,000/- as compensation from the accused. I admit that
I have filed purshis before the Court stating that I have voluntarily
compromised with accused and I have no grievance against the accused
and that I have no grievance if he is acquitted in the matter. These
contents are written with by me voluntarily and I abide by it. Now the
same is shown to me. It is the same. It bears my signature. Contents
therein are true and correct. It is marked at Exh.11.
