ORDER BELOW EXH1
The Ld. Advocate for the complainant is present. She has
filed the application on behalf of the complainant, partnership firm for
the withdrawal of the matter unconditionally. The said application is
signed on behalf of the partner of the complainant firm, who has filed
the complaint before the Court. As per the circular dated 27.11.2020
issued by the Maharashtra State Legal Services Authority, permission is
granted to record the compromise and consent terms through what's
app calling as well as video conferencing facility. The Ld. Advocate for
the complainant has filed on record xerox copy of Aadhar Card signed
by the complainant for his identification. So also, complainant himself
affirmed the contents of the withdrawal application, on verification
through what's app call through his Advocate, who has identified him as
the complainant. Therefore, as the complainant does not want to
proceed with the complaint permission is hereby granted for the
withdrawal of the matter. Accordingly, accused acquitted. Bail bonds,
if any, stand cancelled. The case stands disposed off in LokAdalat.
The complainant is entitled to get refund of full court fees
amount, if paid, i.e. 100% as per the provision of section 89 of the
Cr.P.C.
