This is the case filed under Section 138 r/w. 141 of the
Negotiable Instruments Act. The present matter is pending since last five
years for taking steps. On perusal of roznama, it is seen that the complainant
is absent. So also the complainant has not taken any positive steps. Even
today neither the complainant nor his advocate is present. Thus, it appears
that the complainant is not interested to proceed further with this matter. In
such circumstances, the case comes within the ambit of stale and ineffective
case. Hence, it is kept in Special Drive as per the order no.4340/2023
dt.24/08/2023 passed by Hon'ble Chief Metropolitan Magistrate.
Resultantly, I pass the following order:
ORDER
1] The case is dismissed for want of prosecution.
2] The accused in this case is acquitted of the offence punishable
under section 138 r/w. 141 of the Negotiable Instruments Act.
3] The original documents, if filed on record, be returned to the
concerned party.
4] The case be closed accordingly.
