Matter is kept in Today’s Special Drive. Present complaint
is filed U/s. 138 of Negotiable Instruments Act. It seems from the record
that, matter is posted for dismissal order. Perusal of record, it seem that
the process has been issued on 16/01/2019. Thereafter, the
complainant has filed his last application to re-issue summons to the
accused on 17/06/2019. Therafter, the complainant did not file any
application. Therefore, matter is kept for dismissal order. Today also,
complainant is absent. He has not filed any application nor taken steps
to secure the presence of the accused. Matter is of the year 2019 i.e. 7
years old. Therefore it seems that complainant is not interested to
proceed with the matter. In such circumstances, it would not be
appropriate to keep the matter pending unnecessary without any
progress. In result I pass following order:-
ORDER
1. The case is dismissed vide Section 256 of Cr.P.C. and
accused is discharged.
2. Record and proceeding be sent to record room after
necessary compliance.
