This is the complaint filed under Section 138 r/w 141 and 142 of the
Negotiable Instruments Act. The complainant is present with his advocate.
During the pendency of the case, the complainant filed application for
permission to withdraw the complaint
inter-alia submitting that the accused
persons are not traced out and therefore, the complainant does not proceed
with the case against the accused persons. Hence, I proceed to pass the
following order:
ORDER
(i) The application for withdrawal of the complaint is
allowed.
(ii) The accused is hereby acquitted from the offence
punishable under section 138 r/w 141 and 142 of
the Negotiable Instruments Act. Bail bond
furnished by the accused stands cancelled.
(iii) The original documents i.e. cheque and other
documents, if filed on record, be returned to the
concerned party.
(iv) Court fee stamps, if any, be refunded on demand
only as per rules.
(v) The case be closed accordingly.
