22nd COURT, ANDHERI, MUMBAI.
ORDER BELOW EXH-1 IN C.C. NO. 154/PS/2018
1) This is a summons case instituted otherwise than upon
a complaint. Perused the record & proceedings of this case.
Offence under section 279, 337 of Indian Penal Code read with
section 134 (A) (B) of Motor Vehicle Act is dated 05.11.2017.
Since, long the case is pending for securing presence of accused.
The prosecution could not secure the presence of accused till date,
despite several efforts are made.
2) Considering the nature of the offence and the
punishment provided for the offence, no purpose will be served in
keeping the case pending on board.
3) Hence, this Court is constrained to stop the
proceedings under Sec. 258 of Cr. P. C. In result, the following
order is passed.
ORDER
The proceeding is stopped vide Section 258 of
Cr.P.C. & the accused is discharged of the offence charged
against him.
