ORDER BELOW EXH. 1
1. Accused is charged with the offence punishable under Section
65(e) of the Bombay Prohibition Act. There is no C.A. Report filed on
record, in respect of seized contraband articles. Hence, no purpose will be
served even if the prosecution procure the witnesses. In the circumstances,
I have reached to the conclusion that, this is fit case wherein proceedings
can be stopped. Hence, the order :
ORDER
1. The proceedings are stopped as per Section 258 of Code of
Criminal Procedure.
2. The accused is acquitted.
3. The bail bonds of accused stand cancelled.
4. Seized liquor be destroyed as per rules and the other
Muddemal if any be confiscated to the state.
