In the present matter, the police station Andheri has registered MECR
No.04/2017 u/s. 406, 420, 468, 471 r/w. 34 of IPC. Thereafter, the investigation
was carried out by the investigating officer. After completion of investigation, the
investigating officer has submitted “C” Summary report on 16.12.2017. After filing
the “C” Summary report, the notice was issued to the informant on dtd. 04.01.2018.
In pursuance of notice, the informant appeared and objected the report by filing the
present protest petition on 18 Jan. 2019. Heard Ld. Advocate Mrs. Archana Singh
for the informant. The Ld. Advocate for the informant argued that the report filed by
the concerned police station and the statements are false, fabricated and baseless.
The report is not having any substance of truth and full of false information and
misleading. The report submitted by the investigating officer is false and an attempt
to dilute the matter to cover up all the accused. By filing the protest petition, the
informant prayed to reject the report filed by the police and accused may kindly be
punished in accordance with the law. I have perused the report submitted by the
police station Andheri and the protest petition filed by the informant. Considering
the record, I am satisfied that the contention of the informant is not acceptable
because there are no substantial material available for issuance of process against
accused for any of the offence. Therefore, I am of the view that the report filed by
the police is required to be accepted and the protest petition filed by the informant
is deserves to be rejected. Hence, I pass following order :
ORDER
1. The “C” Summary report submitted by investigating officer in MECR
No.04/2017 of Andheri Police Station is granted and the protest petition is rejected.
2. The original papers be returned to the investigating officer, if any.
