ORDER BELOW EXH-04 IN C.C. NO. 115/PS/2018
1) Accused Ashok Vaijnath Munde has filed this application for
cancellation of BW issued against him. Perused the
application and the say of learned A.P.P. filed. Heard both
sides.
1) Learned advocate for the accused submitted that, non-
appearance of accused is not deliberate. Due to mistake in
date of hearing, he could not attend the Court on the date
fixed for hearing. On his absence, the Court passed order of
BW against him. He also submitted that, henceforth, the
accused will remain present before the Court on time.
2) In view of submissions, the absence does not appear to be
deliberate. Hence, BW stands canceled subject to payment of
Rs.1,000/- towards earlier forfeited bonds. Remaining
amount remitted.
3) Accused shall furnish fresh PB of Rs.7,500/- each.
4) Accused shall remain present on each date henceforth.
5) Call BW without execution. Inform concerned P.S.O.
