ORDER BELOW APPLICAION FILED BY ACCUSED/APPLICANT
FOR PERMISSION TO GO ABROAD
The applicant filed the present application. Applicant is
accused, against whom crime is registered with Amboli police station for
the offence P.U.S. 143 to 147 r/w. 149, 353, 427, 506 ¼ii½ r/w. 34 of
Indian Penal Code. Applicant/accused submitted that, he is desired to go
abroad i.e. at Australia Sydney from 25/01/2018 to 24/01/2019 to take
care of his son Harsh, who is studying there. He is ready to abide by terms
and conditions in respect of permission to go abroad, if allowed. Hence,
he prayed for permission to go abroad.
2. Heard Ld. Advocate Mr. Suhas D. Ghag for accused. In
support of the application applicant have filed his affidavit on record. It is
at (Exh.2 ). In support of his application applicant have filed Copy of
order passed on 17/04/2013 by my Ld. Predecessor, Copy of letter issued
by Department of Education and Tranning, Copy of Visa Entitlement
Verification Onling. Ld. A.P.P. have filed his say and is not having
objection to grant permission to applicant to go to abroad. After going
through the record, in my view the prosecution will not suffer any
hardship, if permission to go abroad to applicant/accused granted.
Therefore, in the interest of justice and for the reasons mentioning
application, I proceed to pass following order.

ORDER
1 The application of applicant/accused viz. Jaymala Jagannath
Sakpal, for permission to go abroad, is hereby allowed on
following conditions.
a The applicant/accused is permitted to go abroad i.e. at
Australia Sydney from 25/01/2018 to 24/01/2019 to take
care of his son Harsh, who is studying there on surety bond of
`.25,000/ .
b The applicant/accused shall furnish her undertaking that, she
will remain present before court, as and when required.
c The applicant/accused shall furnish all the details of her stay
in abroad with her all details and also the place and address
alongwith phone numbers at which she will stay in abroad to
Investigation Officer.
d The applicant/accused shall submit verified copy of her
Passport and other relevant documents with the Investigation
Officer.
e On her returning the applicant/accused shall inform the
Investigation Officer, accordingly.
